1.Definitions​​

"Platform" means the website www.Socialawn.com.

"Accommodation" means the backyard & and surrounding

"Member" means Guest or/and Host or/and any third party service providers, who have a registered account on Socialawn Platform.

"Listings" means Accommodation as listed by the Host and is available for the reservation and/or booking via Socialawn Platform.

"Host" means registered account holder on Socilawn Platform, who creates and maintains the Listings via Socialawn Platform.

"Guest" means registered account holder who rents or book a Listing via Socialawn Platform and stays ("temporarily") at the Accommodation.

"Listing Fees" means Price set by the Host to rent out their Accomodation

"Service Fees" means collectivley Host Fees and the Guest Fees plus any third party charges.

"Guest Fees" means Fees charged to the Guest by Socialawn for the use of Socialawn Platform and its services.

"Host Fees" means Fees charged to the Host by Socialawn for the use of Socialawn Platform and its services.

"Total Fees" means Fees charged by Socialawn that is inlusive of Total Listing Fees and/or Security Deposite and/or Cleaning Fees and/or Guest Fees and/or any third party charges and any applicable Taxes.

"Hosting Services" means the services offered by the Host, also called as Listings on Socialawn Platformm.

"You or Your" means you as a member, unless otherwise specified.

"Terms" means the terms of service that govern access or use of the Socialawn Platform.

"Payment Method"- means a payment method member has added to the Socialawn Platfomr.

"Payout Method"-means a remittance method agreed between the Member and Socialawn Platform.

"Content" means text, graphics, images, music, software (excluding the Application), audio, video, information or other materials.

2.Introduction

By accessing the Socialawn Platform and any of its associated services and functionality (including the Platform and any related sites), you agree to be bound by these terms and conditions of use and the Privacy Policy located at www.Socialawn.com/privacy-policy.

If you do not agree to these Terms of Use or the Privacy Policy, you must not use or continue to use the Platform.

Socialawn reserves the right to amend the Terms of Use from time to time in its sole discretion and, by using the Platform at any time, you acknowledge that you have read, understood and agree to be bound by the current Terms of Use in place.

3. About Socialawn & Socialawn Scope of Services

The Socialawn Platform is an online marketplace that connects Hosts and certain third parties ("collectively called as Hosts"), who offer their services ("are Host Services") to publish such Host Services on Socialawn Platform ("Listings") and to interact and transact directly with the Members ("Registered account holders using Host Services are Guests"). Host Services may include the offering of Backyard or/and Part of the Host Property for use by the Guest by Hours.

Socialawn Platform does not own, create, sell, resell, control or manage any Listings by Hosts. Only Hosts are responsible for their Listings & Host Services.

Socialawn will use its reasonable endeavours to resolve any disputes that may arise between Hosts & Guests. Socialawn has no control over and does not guarantee (i) the existence, quality, safety, suitability, or legality of any Listings or Host Services, (ii) the truth or accuracy of any Listing descriptions, Ratings, Reviews, or other Member Content, or (iii) the performance or conduct of any Member or third party.

If you wish to make a complaint, please email us full details of your dispute at info@Socialawn.com. Following receipt of a dispute notice from you, Socialawn will attempt to mediate a dispute. If mediation is not successful, Socialawn will investigate the complaint in order to determine whether there has been a breach of its Terms and Conditions and make a determination in this regard. Any decision made by Socialawn regarding whether there has been a breach of its Terms and Conditions, and the appropriate action that should be taken, will be final.

Your use of the Platform is governed by, construed and enforced in accordance with the laws of New South Wales, Australia. Disputes arising from your use of this Platform are exclusively subject to the jurisdiction of the courts of New South Wales, Australia.

4. Registration to use the Platform

In order to fully access the Socialawn Platform, you must first register as an Account Holder of the Platform. As part of the registration process, or as part of your continued use of the Socialawn Services, you will be required to submit personal information such as full name, date of birth, address, valid identification and other information to create an Account with Socialawn.

You warrant that any information you provide to Socialawn in the course of completing the registration process will always be accurate, correct and up to date.

Once you have completed the registration process, you will hold an Account with Socialawn and be an Account Holder of the Platform and agree to be bound by these Terms of Use.

You must not use the Platform, if

(a) You are under 18 Years of age or lack capacity to form a binding contract with Socialawn; or

(b) You are a person barred from receiving the Platform Services under the laws of Australia or the laws of other relevant countries including the country in which you are resident or from which you use the Platform Services.

5. Your obligations and prohibited use of the Socialawn Platform

You must use the Platform Services only for purposes that are permitted by:

(i) these Terms of Use;

(ii) any applicable law, regulation or generally accepted practices or guidelines in the relevant jurisdictions.

You must protect the confidentiality of your password and/or email address. Use of your password by any other person may result in the immediate cancellation of your Account.

Any disclosure of or use of your password or registration information by any other person, or third party, is strictly prohibited. You agree to immediately notify Socialawn of any unauthorised use of your password or email address or any breach of security of which you have become aware.

Access and use of the Platform is limited, non-transferable and allows for the sole use of the Platform by you for the purposes of Socialawn providing the Platform Services.

You agree that you will not engage in any activity that directly or indirectly interferes with or disrupts the operation of the Platform or their services in anyway (or the servers and networks which are connected to the Platform) or use the Platform in a manner that adversely affects the availability of their resources to others.

Socialawn cannot guarantee that any file available for download and/or execution from or via the Platform is free from viruses or other conditions which could damage or interfere with data, hardware or software with which it might be used. You assume all risk of use of all programs and files on this site, and you release Socialawn entirely of all responsibility of any consequences of their use.

The Platform and their content are provided to you on "as is" basis; the Platform may contain errors, faults and inaccuracies and may not be complete and current.

You must not:

(a) use the Platform for any activities, or post or transmit to or via the Platform any information or materials which:

(i) breaches any laws or regulations, infringes a third party's rights or privacy, or which are contrary to any applicable standards or codes;

(ii) interferes with other users, or defames, harasses, threatens, bullies, or offends any person, or which inhibits any other user from using the Platform;

(iii) is obscene, indecent, discriminatory, inflammatory or pornographic or which could give rise to civil or criminal proceedings;

(b) use the Platform to send unsolicited commercial or bulk electronic messages;

(c) make any fraudulent or speculative enquiries, reservations or requests using the Platform;

(d) provide false information when registering or changing your registration details;

(e) tamper with, hinder the operation of or make unauthorised modifications to the Platform;

(f) knowingly transmit any virus or other disabling feature to or via the Platform; or

(g) attempt any of the above acts or permit another person to do any of the above acts.

6. Intellectual Property Rights

The Platform and all content forming part of the Platform, including without limitation all photographs, images, designs, information, interfaces, text, graphics, brand names, logos and trademarks, are protected by copyright, trade mark and other intellectual property laws.

You acknowledge and agree that Socialawn owns, controls or is licensed all legal right, title and interest in and related to the Platform, including all intellectual property rights.

You may not:

(a) modify or copy the layout or appearance of the Platform or any computer software or code contained in the Platform; and/or

(b) decompile or disassemble, reverse engineer or otherwise attempt to discover or access any source code related to the Platform.

Except where permitted under the Australian Copyright Act (Cth) or other applicable laws, and except for the temporary copy held in your computer's cache and a single copy for your own personal use, any of the Platform’ content (including any substantial part of them) must not otherwise be used, stored, copied reproduced, published, altered, adapted, distributed, printed, displayed, transmitted or commercialised in any form or by any means in whole or part without our prior written consent.

If you correspond or otherwise communicate with Socialawn, you automatically grant to Socialawn an irrevocable, perpetual, non-exclusive, royalty-free, world-wide license to use, copy, display and distribute the content of your correspondence or communication and to prepare derivative works of the content or incorporate the content into other works in order to publish and promote such content. This may include, but is not limited to, publishing testimonials on our Platform and developing your ideas and suggestions for improved products or services we provide.

7. Privacy

8. Warranties

You warrant that:

a) You have read and understood the Terms of Use and agree to comply with the Terms of Use at all times;

(b) You have not been induced to enter into using the Platform or make a purchase by reason of any promise, representation, warranty or guarantee or undertaking whatsoever other than as is expressly stated in the Listing or these Terms of Use;

(c) You have been given the opportunity to take legal advice on the terms of these Terms of Use;

(d) You have the capacity, power and authority to agree to these Terms of Use and have taken all necessary action in order to agree to these Terms of Use; and

(e) You have obtained all third party approvals necessary for you to agree to these Terms of Use.

9. Indemnities

You agree to release, defend, indemnify Socialawn, its related bodies corporate and their directors, employees, contractors, agents, workers and personnel and shall keep them indemnified against all actions, costs, charges, claims and demands arising out of or in any way connected with (a) your access to or use of the Platform, or your violation of these Terms; (b) your Member Content; (c) your (i) interaction with any Member, (ii) Booking of an Accommodation, or (iii) creation of a Listing; and (d) the use, condition or Booking of an Accommodation by you, including but not limited to any injuries, losses, or damages (compensatory, direct, incidental, consequential or otherwise) of any kind arising in connection with or as a result of a Booking or use of an Accommodation.

(a) any breach of these Terms of Use by you including without limitation the enforcement or the attempted enforcement of these Terms of Use; and

(b) any act or omission by you or your employees, contractors, workers or agents.

10. Third party Website

The Platform may contain links to other web sites controlled by third parties (Third Party Website).

Socialawn is not responsible for the content or privacy practices of Third Party Website.

The links to Third Party Websites are provided solely for your convenience and do not constitute, expressly or impliedly, an endorsement by Socialawn of the third party or the products or services provided by the third party or any affiliation between Socialawn and the third party.

You access those sites and/or use those site’s products and services solely at your own risk and should make your own enquiries before relying on any content contained in such Third Party Website.

11. Use of Cookies

Cookies are small pieces of information that your browser stores on your computer hard drive. Socialawn uses Cookies to provide you site usage information as well as to assist us to improve and develop the Goods and services it offers. Our cookies do not contain any personal identifiable information.

If you disable Cookies on your web browser, you may not be able to fully experience all features of the Platform.

12. Accuracy of communications

You are exclusively responsible for ensuring that all communications, whether in writing, via telephone or in electronic or paper form, sent by you using the Platform are true, complete and accurate.

If you are or ought reasonably to be aware that a communication has been corrupted, you must re-transmit or re-send that communication as soon as practicable after becoming aware or having the reasonable apprehension that the communication has been corrupted, together with a clear indication that it is a corrected communication.

To the fullest extent permitted by any applicable laws, Socialawn hereby excludes and takes no responsibility and will not be held liable for any errors, omissions or misstatements on or related to the Platform.

13. Availability, withdrawal and suspension of service

Whilst Socialawn endeavours to provide continuous access to the Platform, Socialawn does not warrant that your access will be safe, uninterrupted, timely, secure or error free.

Socialawn may at its discretion withdraw completely, or suspend for a period of time, the Platform, or access to it for any reason including without limitation:

(a) if there is an interruption, system failure, fault, virus, maintenance or repair requirement, unauthorised access, denial of service or other malicious attack on any part of our computer or telecommunications system;

(b) if you breach any part of these Terms of Use; or

(c) if you use or assist others to use the Platform for an inappropriate or unlawful purpose, including the storage or transmission of inappropriate, unlawful or offensive material.

14. Exclusion and limitation of liability

We do not warrant that the Platform will be available at all times or that it will be provided without fault or disruption.

Socialawn and its directors, officers, employees, agents, contractors, successors or assignees makes no representations or warranties of any kind, express or implied as to the operation of the Platform or the information, content or material included or services described on the Platform, except as otherwise provided under applicable laws.

Subject to any rights you have under any consumer protection law, Socialawn excludes to the fullest extent possible under law, all implied terms and warranties whether statutory or otherwise, relating to the subject matter of these Terms of Use.

Where any law (including the Australian Consumer Law) provides a consumer guarantee which may not be lawfully excluded, Socialawn’ liability will be limited to that provided by law.

To the maximum extent permitted by applicable law, neither Socialawn, nor its directors, officers, employees, agents, contractors, successors or assigns will be liable for any losses, costs or damages (including, without limitation, damages for loss of business profits, business interruption, loss of business information or data, or other pecuniary loss) whether those damages are direct, indirect, punitive, incidental, special or consequential damages, arising out of or in any way related to:

(a) the Platform;

(b) your use of the Platform and any sites linked to the Platform;

(c) any information obtained through the Platform;

(d) services supplied to you following your use of the Platform;

(e) reliance on or failure to act, on any information or service contained on or accessed through the Platform;

(f) a withdrawal or suspension of availability of services;

(g) errors, mistakes, inaccuracies or omissions on the Platform;

(h) personal injury or property damage of any nature resulting from your access to or use of the Platform;

(i) any unauthorised access to or use of our secure servers and/or Personal Information and/or financial information stored on those servers;

(j) any bugs, viruses, trojan horses or other harmful code or communications which may be transmitted to or through our Platform by any third party;

(k) the quality of any product or service of any linked sites; or

(l) an inability to use the Platform or with any delay in using the Platform including, but not limited to, any interruptions to or cessation of access to the Platform, in any case whether based on actions arising in contract, tort or otherwise howsoever arising, including negligence.

Socialawn’ liability to you for loss or damage of any kind arising out of these Terms of Use will be reduced or limited to the extent (if any) that you directly or indirectly cause or contribute to any of the loss or damage.

Without limiting the foregoing, to the extent permitted by law, Socialawn limits its liability in respect of any claim to the supply of the Platform Services again.

You agree to accept sole responsibility for the legality of your actions under the laws which apply to you. You agree that Socialawn and its directors, officers, employees, agents, contractors, successors, assignees and suppliers have no responsibility for the legality of your actions.

15. Termination

You may stop using the Platform at any time for any reason.

Socialawn may suspend or limit your access to the Platform in its absolute discretion without notice or liability to you for any reason.

Socialawn reserves the right to, at its discretion, terminate these Terms of Use or your access to and use of the Platform at any time.

The exclusions and limitations of liability made by Socialawn in these Terms of Use will survive termination or suspension of your access to the Platform.

16. General

Socialawn may in its sole discretion amend these Terms of Use at any time. Any variations to these Terms of Use will take effect from posting on the Platform.

Socialawn may give notice to you by electronic mail. You may give notice to Socialawn by electronic mail to info@Socialawn.com.

Any provision of these Terms of Use that is prohibited or unenforceable in any jurisdiction is ineffective as to that jurisdiction to the extent of the prohibition or unenforceability. That does not invalidate the remaining provisions of these Terms of Use nor affect the validity or enforceability of that provision in any other jurisdiction where it may be lawful.

A failure or delay by Socialawn to exercise a power or right under these Terms of Use does not constitute a waiver of that power or right, and the exercise of a power or right by Socialawn does not preclude its future exercise or the exercise of any power or right by or on behalf of Socialawn.

Your use of the Platform is governed by, construed and enforced in accordance with the laws of New South Wales, Australia. Disputes arising from your use of this Platform are exclusively subject to the jurisdiction of the courts of New South Wales, Australia.

The Platform may be accessed throughout Australia and overseas. Socialawn makes no representations that the content of the Platform complies with the laws (including intellectual property laws) of any country outside Australia. If you access this Platform from outside Australia, you do so at your own risk and are responsible for complying with the laws in the place where you access this Platform.

17. Terms for Hosts

As a registered account holder, you may create Listings of your Host Service in accordance with our terms & shall include following:

Description, Location- a physical address, Date/hour availability, any event rules, any rules for the Guest, Disclose any deficiencies & restrictions.

You are responsible to provide any other relevant information about the Listing, as requested by Socialawn.

You are responsible to keep your Listing information accurate and up-to date at all times.

You are solely responsible for setting up a price (including any Taxes if applicable, or any other charges that may apply). Once the Guest’s request a booking of your Listing, you will adhere to the price as mentioned in your Listing.

You agree to adhere to any terms & conditions as mentioned by you in the Listing, including the cancellation terms & must not conflict with the terms & policies for your Listing.

Socialawn reserves the right to require that your Listings have a minimum number of Images in a certain format, size and resolution.

Pictures shared by you should reflect the true quality & condition of your Host services.

The placement and/or ranking of your Listings in search results on Socialawn may depend on a variety of factors, including, but not limited to, Guest and Host preferences, price, ratings, ease of Booking, quality of images, customer service & cancellation history.

If you accept or approve a booking request by a Guest, you will enter into a legally binding agreement with the Guest & Socialawn & are required to provide your Hosts service to the Guest, as described in your Listing at the time of booking request is made. You are also liable & agree to pay the applicable Host Service Fee & any applicable Taxes.

You acknowledge and agree that any Listing you post will be a true & accurate description of your Hosts service’s. You represent and warrant that any Listing you post and the Booking of, or a Guest’s stay at, an Accommodation in a Listing you post (i) will not breach any agreements you have entered into with any third parties, such as a homeowners association, condominium association, or other third party agreements, and (ii) will (a) be in compliance with all applicable laws (such as zoning laws), tax requirements, intellectual property laws, and rules and regulations that may apply to any Accommodation included in a Listing you post (including having all required permits, licenses and registrations). As a Host, you are solely responsible for your own acts and omissions and are also responsible for the acts and omissions of any individuals who reside at or are otherwise present at the Accommodation at your request or invitation, excluding the Guest and any individuals the Guest my invites to the Accommodation.

18. Terms for Guests

Subject to meeting Socialawn verification process and/or by the Host, you can book a Listing, as available on Socialawn Platform, by following Socialawn booking process & paying applicable Fees & Taxes. Socialawn will present you a breakup of all applicable Fee, including Listing Fee (as demanded by the Host), Security Deposit (if applicable), Cleaning Fee (if applicable), Guest Fee (if applicable) and any applicable Taxes, (collectively called as "Total Fee") and You agree to pay the Total Fee for any booking request with reference to your Socialawn account.

Once the Host accepts a booking, Socialawn will provide you a booking receipt. Upon confirmation of the booking, you will enter into a legal binding agreement between You and Your Host, subject to terms & conditions of the Host that may apply, including the applicable cancellation policy and any rules and restrictions, as specified in the Listing.

If you book a Host Service on behalf of additional Guests, you are required to ensure that every additional Guest meets any requirements set by the Host, and is made aware of and agrees to these Terms and any terms and conditions, rules and restrictions set by the Host. If you are booking for an additional Guest who is a minor, you represent and warrant that you are legally authorized to act on behalf of the minor.

19. Insurance

As a Host, you acknowledge & agree that Socialawn does not act as an insurer. Socialawn highly recommends that Host should obtain necessary insurance for their accommodation & review any existing insurance policies that you may have.

Socialawn may hold a security deposit from the Guests at the time of booking, and which will be payable by the Guest at the time of booking. Socialawn will hold such security deposit for a period of (3) business days. The Host must send evidence of the damage, including but not limited to photographs to Socialawn. Please read Damages and Claims section for more details.

20. General Payments and Booking Accommodations Terms

Socialawn uses PayPal as a third party payment gateway provider. In accepting these Terms of Use and using the Platform, you warrant that you have familiarised yourself with, and agree to be bound by, the applicable Terms and Conditions of Use, Privacy Policy and other relevant legal documentation of PayPal from time to time.

You agree and authorize Socialawn to store your Payment Method information and charge your payment as outlined in these Payment Terms. If your Payment Method’s account information changes, Socialawn will ask you to update the Payment information or/and will acquire this information from Socialawn financial services partner or your bank to update your Payment Method on file in your socilawn’s account.

Socialawn reserves the right to setoff any amounts owed to you by Socialawn with any amounts you may owe Socialawn.

Socialawn, in its sole discretion, may increase or discount a Host’s Listing price or a Guest’s Booking cost in any matter it deems appropriate, including but not limited to providing promotional codes & discounts to Guests.

21. Bookings & Financial Terms For Hosts

If You accept or approve a booking request by a Guest, You will enter into a legally binding agreement with the Guest and are required to provide your Hosts Service to the Guest, as described in your Listing at the time of booking request is made. You are also liable & agree to pay the applicable Host Service Fee & any applicable Taxes.

Socialawn will make the payout to the Host within 48 Hours, after the Guest has checked in. This Payment will be Listing Fee less the Host Fees & Taxes (if applicable). Socialawn will Payout the Hosts as per the Hosts selected Payout method e.g. via Paypal or any other method agreed between Host and Socialawn.

22. Bookings & Financial Terms For Guests

Subject to meeting Socialawn verification process and/or by the Host, you can book a Listing, as available on Socialawn Platform, by following Socialawn booking process & paying applicable Fees & Taxes. Socialawn will present you a breakup of all applicable Fee, including Listing Fee (as demanded by the Host), Security Deposit (if applicable), Cleaning Fee (if applicable), Guest Fee (if applicable) and any applicable Taxes, (collectively called as "Total Fee") and You agree to pay the total Fee for any booking request with reference to your Socialawn account.

Once the Host accepts a booking, Socialawn will provide you a booking receipt. Upon confirmation of the booking, you will enter into a legal binding agreement between you and your Host, subject to terms & conditions of the Host that may apply, including the applicable cancellation policy and any rules and restrictions, as specified in the Listing.

Depending on your chosen Payment Method, Socialawn will collect the Total Fees upon the Hosts confirmation of your booking request.

23. Service Fee

Socialawn will charge Fees to Hosts (Hosts Fee) and Guests (Guests Fee) ("Collectively called as Service Fee") in consideration for the use of Socialawn Platform.

Socialawn will present you a breakup of all applicable Fee, including Listing Fee (as demanded by the Host), Security Deposit (if applicable), Cleaning Fee (if applicable), Guest Fee (if applicable) and any applicable Taxes, (collectively called as "Total Fee")

You are responsible for paying the Service Fees that you owe to Socialawn.

24. Cancellations and Refunds

Cancellations as a Host

As a Host, if you cancel a confirmed booking, the Guest will receive a full refund of the total Fee paid at the time of the booking. Socialawn will publish an automated review on the Listing cancelled by the Host, indicating that a booking was cancelled. As a Host if you cancel a confirmed booking, you will be liable to pay a cancellation Fee to Socialawn.

The cancellation Fee will be calculated based on the time it was cancelled by You & how soon before the check in date:

Cancellations made in more than 72 Hours before the check in date/time, Socialawn will charge 50% of the Total Listing Fee (including Host Service Fee)

Cancellations made in less than 72 Hours before the check in date/time, Socialawn will charge cancellation Fee equal to the Total Listing Fee (including Host Service Fee)

In addition, Socialawn will make your calendar unavailable or blocked for Listing for the dates of the cancelled booking.

Cancellations as a Guest

As a Guest, you can cancel the bookings any time pursuant to the Listing’s cancellation policy set by the Host.

The cancellation Fee will be calculated based on the time it was cancelled by You & how soon before the check in date:

Cancellations made in more than 72 Hours before the check in date/time, Socialawn will charge 50% of the Total Listing Fee (including Guest Service Fee)

Cancellations made in less than 72 Hours before the check in date/time, Socialawn will charge cancellation Fee equal to the Total Listing Fee (including Guest Service Fee)

Cancellations due to Act of God

Socialawn will not charge either Member ("Host and/or Guest") in an extraordinary natural event, such as extreme weather, flood, earthquake, or similar natural disaster that cannot be prevented or foreseen and which contracting parties have no reasonable control over and neither Member ("Host and/or Guest") will have a legal responsibility to continue performance of the contract.

Other circumstances

Socialawn may be able to give you a refund or waive off the cancellation Fee if either Member ("Host and/or Guest") have to cancel because of an unexpected circumstance’s that is beyond your control.

Following is a list of these circumstances covered:

Unexpected serious illness and/or injury

Government mandate obligations

Unforeseen property damage

All of the above cancellation wavers will occur before the official check in date for your event.

25. Damages & Security Deposits

Guests will be responsible for leaving the Accommodation (including any personal or other property located at an Accommodation) in the condition it was in when you arrived. You acknowledge and agree that, as a Guest, you are responsible for your own acts and omissions and are also responsible for the acts and omissions of any individuals whom you invite to, or otherwise provide access to, the Accommodation. In the event that a Host claims and provides evidence of damage to its Accommodation ("Damage Claim"), including but not limited to photographs, you agree to pay the cost of replacing the damaged items with equivalent items. Such cost may be collected from the Payment Method used to book the Accommodation, or any other Payment Method on file at the time of the Damage Claim. Socialawn reserves the right to collect payment from you and pursue any means available if it is unable to collect from the Payment Method.

If a Host has made a Damage Claim, The Host may raise a dispute and seek payment from the Guest via Socialawn. The Host must send evidence of the damage, including but not limited to photographs to Socialawn as evidence of Damage’s.

Members agree to cooperate with and assist Socialawn in good faith and to provide Socialawn with such information as well as to take such actions as may be reasonably requested by Socialawn, in connection with any Damage Claims or other complaints or claims made by Members relating to Accommodations or any personal or other property located at an Accommodation or with respect to any investigation undertaken by Socialawn or a representative of Socialawn regarding use or abuse of the Platform. Members agrees to participate in mediation or other resolution process with other Members, at no cost to the Members, which process will be conducted by Socialawn or a third party selected by Socialawn, with respect to losses for which the Host is requesting payment from Socialawn under these terms.

26. Taxes

Socialawn cannot and does not provide or offer tax related advice to any Members.

As a Host, You are solely responsible to determine (i) Your applicable tax reporting requirements. (ii) Amount or Percentage or Taxes to be included in your Listings. You are also responsible to remit any Taxes to the relevant authority.

You understand and acknowledge that appropriate governmental bodies, departments or authorities (the "Tax Authority") where your Accommodation is located may require Taxes to be collected from Guests or Hosts on the amount paid for the right to use and/or occupancy of Accommodations, and to be remitted to the respective Tax Authority. The laws in jurisdictions may vary, but these Taxes may be required to be collected and remitted as a percentage of the Listing Fees set by Hosts, or a set amount per day, and are sometimes called "occupancy Taxes," "hotel Taxes," "lodging Taxes," "transient Taxes," "sales and use Taxes," "value added Taxes," (hereafter, "Occupancy Taxes").
